  Ranks: Users can participate in ranking systems based on performance and achievements.

13. Internet Traffic and Connectivity

• 13.1. Potential Issues: As a result of high internet traffic, transmission problems, system capacity limitations, and other problems, you may, at times, experience difficulty accessing the WorkoutFusion App or communicating with WorkoutFusion through the internet or other electronic or wireless device.
• 13.2. Device Limitations: Any computer system or other electronic/mobile device used to access the WorkoutFusion App can experience unanticipated outages or slowdowns, or have capacity limitations.
• 13.3. Dependency on Service Provider: Your uninterrupted and satisfactory use of our App shall, to a great extent, depend on your internet service provider, uninterrupted internet connection on the mobile or data network/Wi-Fi Connection on your mobile/cellphone/tablet.
• 13.4. No Continuous Guarantee: WorkoutFusion does not guarantee continuous, uninterrupted, or secure access to its App.

14. Content and Virus Disclaimer

• 14.1. Content Contamination Disclaimer: WorkoutFusion does not guarantee that any postings, messages, text, files, photos, videos, comments, images, or any such material ("Content") posted on our App/Website will be free from viruses that may have contaminating or destructive elements.
• 14.2. Download and Usage Disclaimer: Any Content may be downloaded/used by you solely at your own risk and discretion. WorkoutFusion shall not be liable for any harm whatsoever, caused to your computer system or loss of any data resulting from the download of such data/content.
• 14.3. Security Safeguards Responsibility: It shall be your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) on your computer, laptop, mobile, tablet, or any other device connecting you to our Website to satisfy your requirements as to the safety and reliability of the Content.

• 16.1. User Responsibility: The user hereby agrees not to post, email, or otherwise make available Content:
• 16.1.1. Unlawful or Harmful Content: that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way;
• 16.1.2. Discriminatory Content: that harasses, degrades, intimidates or is hateful towards an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
• 16.1.3. False Representation: that impersonates any person or entity, including, but not limited to, a WorkoutFusion employee, or falsely states or otherwise misrepresents your affiliation with a person or entity (this provision does not apply to Content that constitutes lawful non-deceptive parody of public figures);
• 16.1.4. Unauthorized Personal Information: that includes personal or identifying information about another person without that person's explicit consent;
• 16.1.5. Deceptive Content: that is false, deceptive, misleading, deceitful, mis-informative, or constitutes "bait and switch";
• 16.1.6. Infringing Content: that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
• 16.1.7. Unsolicited Commercial Content: that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;

• 17.5. Unauthorized Data Collection: collect personal data about other users for commercial or unlawful purposes;
• 17.6. Automated Data Download: use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service, unless expressly permitted by WorkoutFusion;
• 17.7. Excessive Posting: post non-local or otherwise irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;
• 17.8. Unauthorized Access: attempt to gain unauthorized access to WorkoutFusion's computer systems, servers or engage in any activity that disrupts, diminishes the quality of, or interferes with the performance of, or impairs the functionality of, the Service or the App;
• 17.9. Content Alteration: remove or change any content of the WorkoutFusion app or attempt to circumvent security or interfere with the proper working of the WorkoutFusion domain or any servers on which it is hosted;
• 17.10. Misuse of Information: misuse passwords or misuse of other information or content on the WorkoutFusion app;

• 17.14. Code Misuse: misuse, replicate or copy the source code and the object code contained in the computer program of the WorkoutFusion app;
• 17.15. Non-Permitted Actions: otherwise do anything that is not expressly permitted by the terms of this "Terms of Use" document.
• 17.16. Liability for Activities: You are entirely liable for activities conducted by you or anyone else in connection with your browsing and use of the WorkoutFusion App. If you are dissatisfied with the WorkoutFusion app or with any of the terms of this "Terms of Use" document your sole and exclusive remedy is to stop using the WorkoutFusion App. Neither WorkoutFusion nor any third-party provider will be liable for any damages in connection with your browsing or use of the WorkoutFusion app.

Disclaimer of Information Accuracy: Although the information provided to you on this app is obtained or compiled from sources which we believe to be reliable, neither WorkoutFusion, nor any of its subsidiaries, directors, officers, employees, or any third-party vendor guarantee you the accuracy, completeness, or comprehensiveness of the information or other content provided through this app.

20.Violation and Remedies

• 20.1. Account Disablement/Legal Action: In case of any violation, we reserve the right to disable/ban your account or take legal action against you or both as necessary.

21.Prohibited Actions

• 21.1. You must not:

  • 21.1.2. Sell, rent or sub-license material from WorkoutFusion
  • 21.1.3. Reproduce, duplicate or copy material from WorkoutFusion

• 22.1. User-Generated Content: Parts of this app offer an opportunity for users to post and exchange opinions and information in certain areas of the app. WorkoutFusion does not filter, edit, publish or review Comments prior to their presence on the app. Comments do not reflect the views and opinions of WorkoutFusion, its agents and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, WorkoutFusion shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this app.

Disclaimer of Content Responsibility: We shall not be held responsible for any content that appears on your app. You agree to protect and defend us against all claims that are rising on your app. No link(s) should appear on any app that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

24.Reservation of Rights

• 24.1. Link Removal Request: We reserve the right to request that you remove all links or any particular link to our app. You approve to immediately remove all links to our app upon request. We also reserve the right to amend these terms and conditions and its linking policy at any time.
